The Centre filed an affidavit on Wednesday opposing the plea seeking inclusion of Scheduled Caste converts to Christianity in the list of Scheduled Castes. The petition has argued that exclusion of Christian and Muslim Dalits from the list of Scheduled Castes, when Dalits of the Hindu, Sikh and Buddhist faith are being categorised as SCs, was discriminatory. “The Constitution confers on each individual the fundamental right to profess, practice and propagate his religion. However the individual right to freedom of conscience and religion cannot be extended to construe a collective right to proselytize,” the bench said and added that the right to religious freedom belongs equally to the person converting and the individual sought to be converted. The conversion programme was going on and many villagers belonging to the scheduled castes community were being converted from Hinduism to Christianity. The Andhra Pradesh High Court has ruled that individuals belonging to Scheduled Castes (SC) lose their SC status immediately upon converting to Christianity, thereby forfeiting protections under the SC/ST Prevention of Atrocities) Act. Pastor Chintada Anand from Kothapalem, Guntur district, who had filed a complaint under the SC/ST Act. a pastor for over a decade, lodged a complaint with the Chandolu police, alleging that Akkala Ramireddy and others had abused him based on his caste. The police registered a case under the SC/ST Act. However, Ramireddy and others challenged the case in the High Court, seeking its dismissal. The petitioners’ counsel, Phani Dutt, argued that Anand, having converted to Christianity and served as a pastor for ten years, no longer qualified as an SC member under the Constitution Scheduled Castes Order. The order states that SC individuals who adopt a religion other than Hinduism lose their SC status. Justice Harinath clarified that conversion to Christianity, where caste distinctions do not exist, nullifies SC status regardless of any existing caste certificate.
